In Jan 2007 after our home did not sell we went into a verbal agreement with one of the two agents. One of the agents wanted to rent it and the other said she would manage it for us at no cost. We were military and getting stationed overseas so it seemed like a win win. We agreed that when the time did come to try to sell our house again we would use her. Flash forward to May 2010 and we took over managing the property which was now is poor shape. In May 2012 we decided to try again to sell and offered her the job. She was bitter and said she wanted nothing to to with it. We got another agent and sold the house at a loss. She is now threatening to sue us for the commission promised to her. Does she have a case? This is in Georgia.

She has no case without a written agreement signed by you and her.

Why was she "bitter" and not willing to take the listing when you offered it to her? And why would she ask for commission after turning down the listing opportunity? I see no reason she is owed any commission based on your post.

We initially tried to rent the property and she was upset that we didn't want to use her for trying to rent the property. She basically said "go *********rself" when we decided to sell.

Verbal Agreement is not binding - tell the agent she is an unprofessional POS and to go pound sand. She is an example of everything wrong with the industry. Wants a paycheck but lets the rental goto hell in a handbasket and then declines the listing and still expects to get paid. She must be on crack!

I agree with the others in this post. If Ms. Grumpy threatened to sue, you should tell her that you will report her to the local Realtor's association. That would shut her up fast.

LOL. She has no written agreement plus she also turned down the opportunity to list but now she wants commission???

The nerve of some agent. She has absolutely no case and she's a moron for even suggesting it. You guys should thank your lucky star she turned it down, she obviously doesn't know what the heck she's doing.

I cant even tell you how many times people have said they are going to sue me. None of them ever do. Why? Because they have no case and they will loose. People are emotional and just blurt out whatever comes to their head when they get angry. In today's society, people say "im going to sue you" or "see you in court". Its a common emotion when people are upset.

Just ignore her threats and get on with your life.

Verbal contracts are as good as the paper they are written on.

When people threaten to sue you, they are not planning to sue you at all.

Folks that actually sue, they don't threaten ahead of time. They let the lawsuit do the talking.

Regardless, she has no case. No contract was breached...there was nothing in writing.
